Created in 2018, EQUIMAF is a company specializing in the sale of equipment, hardware and management software for business. She also works in the field of governance, audit and information technology security consulting. Wanting to be a center of excellence in advanced use of microcomputing training, EQUIMAF is thus moving towards recognition of skills as a key to job creation.

 

Purpose and scope

Any order for hardware and software placed with ÉQUIMAF implies unreserved acceptance by the Purchaser and full and complete acceptance of these general conditions of sale which prevail over any other document of the Purchaser, and in particular over all general conditions. purchase, except with special and express agreement from EQUIMAF. These general conditions of sale apply to all sales of EQUIMAF hardware and software, except by specific agreement prior to the order agreed in writing between the Parties. Any document other than these general conditions of sale and in particular catalog, prospectus, advertisements, notices, is only informative and indicative. These general conditions of sale are communicated to any Buyer who requests them. The Seller reserves the right to modify its general conditions from time to time. Availability of items

All orders are served from our Internet warehouse; Items that we have in stock are normally dispatched within 48 hours. Items that we do not keep in stock can usually be ordered and will be delivered within two to three weeks.

When a supplier informs us that an item on order is no longer available, the customer receives an email notification.

Except in cases of force majeure or during periods of closure clearly announced on the home page of the EQUIMAF site, shipping times will be, within the limits of available stocks, those indicated by EQUIMAF when ordering. In the event of delay, the Seller's liability cannot be engaged, for any reason whatsoever. Therefore, no claim for compensation of any kind whatsoever can be claimed by the Buyer. In case of unavailability of the ordered product, the Buyer will be informed as soon as possible. The cancellation of the order for this product and its possible refund will then be made, the rest of the order remaining firm and final. Products in stock will be delivered. However and in the event of non-cancellation of the order for an exhausted product, the Customer may ask the Seller in writing to wait for the availability of all the products to be delivered at one time.

Order modification

Orders sent to ÉQUIMAF are irrevocable for the Customer, unless accepted in writing by ÉQUIMAF. In the event of modification of the order by the Customer, EQUIMAF will be released from the agreed deadlines for its execution

 

Price-price-Price reduction

Price

The prices displayed on the site http://www.equimaf.ca are in Canadian dollars, before taxes and shipping costs. The price is payable in full and in a single payment at the time of the order. All orders are payable in Canadian dollars. For all deliveries outside of Canada, any customs charges and local taxes remain the responsibility of the recipient.

The prices are set by the EQUIMAF tariff in force on the day the order is placed. They always get along tax free. VAT and all other taxes not included will be invoiced in addition. On this point, EQUIMAF reserves the right to pass on without delay any new tax or increase in the rate of existing taxes. The transport costs are indicated on the estimate and are the responsibility of the customer. These fees appear on all EQUIMAF sales proposals.

Shipping fees

The shipping costs cover the costs of preparation and packaging, plus postage. They are established according to the delivery address, the number of items ordered and the total amount of the order, before taxes and shipping costs. Under no circumstances will a customer be able to combine several orders to benefit from a reduction in shipping costs.

Payment

Orders placed on the site http://www.equimaf.ca or by telephone must be paid by credit card. We accept VISA, MASTERCARD and AMERICAN EXPRESS cards. Postal orders can be paid by money order and check.

 

Digital products

The customer can download the digital products purchased on the site http://www.equimaf.ca as soon as the transaction has been accepted. The number of downloads allowed and the number of devices on which the same digital file can be installed may change without notice and vary according to the distributor and the publisher.

The digital files acquired are the works of authors and are protected by copyright law. In accordance with this law, the purchase of digital files is reserved for personal, private and free use. Any reproduction other than that authorized for downloading, adaptation, collective use, resale or rental is absolutely prohibited and may be the subject of legal proceedings.

The end user undertakes to respect the rights of authors, performers and publishers of digital books and not to circumvent or infringe on techniques for controlling the use of downloaded digital books. Otherwise, any use outside the framework defined in these general conditions of sale constitutes an act of infringement, which exposes the end user to legal proceedings.

No exchange, credit or refund will be accepted after confirmation of a digital product sale transaction. Equimaf can in no way be held responsible for any compatibility problems between a digital product and an electronic device, resulting in particular from developments in reading software or technical measures to protect files, except in the event that the description of the product displayed would be inaccurate.

Finally, Equimaf, not being the owner of the files, cannot guarantee their availability for additional downloads in the future, when more than 72 hours have elapsed following the purchase. It is the customer's sole responsibility to save files purchased through the equimaf.ca site and to make backup copies of these files.

Payment

The price is payable in cash, in full, on delivery or removal of the equipment or under the conditions set out in the estimate. The price is payable by bank transfer or bank check. No cash payment is accepted.

Payment terms may be agreed on a case-by-case basis by EQUIMAF.

Late payment

Any amount including tax not paid by the due date will give rise to the payment by the Customer of penalties set at three times the legal interest rate. These penalties are payable as of right on the day following the payment date appearing on the invoice and will automatically be debited from the Customer's account. No reminder or formal notice will be necessary to trigger the penalties for delay. EQUIMAF reserves the right to ask the Customer for additional compensation if the collection costs actually incurred exceed this amount, on presentation of supporting documents. The delay in payment may also give rise to the suspension of orders and deliveries in progress and to the withdrawal of any possibility of payment delay which would have been granted by EQUIMAF.

 

Electronic invoice

The Customer accepts without reservation to receive his EQUIMAF invoices exclusively by electronic means. Consequently, the Customer expressly declares to definitively renounce to receive invoices in paper format.

 

Receipt of goods

The Customer is required to check the condition of the packaging, the number and content of the packages, as well as the condition of the products upon delivery. The Customer must formulate in writing to EQUIMAF on the same day of delivery or at the latest on the first working day following delivery, any complaint of delivery error and / or non-conformity of the products in kind or in quality with respect to to the information on the order form. In addition, the Customer must indicate in a handwritten manner on the delivery / transport slip, in the presence of the carrier, all reservations written in a clear, precise and complete manner. The Customer and the carrier will date and sign the reservations.

If the carrier refuses to sign the reservations, the Customer must indicate this refusal on the delivery slip. At the same time, the Customer must send a registered letter with acknowledgment of receipt resuming his complaints to the carrier within 3 days of delivery of the goods. The Customer must send ÉQUIMAF a copy of this letter and that of the delivery note containing the reservations within 5 days of delivery. Any complaint not made in accordance with the rules specified above and within the time limits will not be taken into account and will release EQUIMAF from any liability vis-à-vis the Buyer.

 

Retention of title

EQUIMAF remains the owner of the equipment (hardware and / or software) until full payment of their price in principal and interest. In the absence of full payment of the price of the goods, in principal and interest, EQUIMAF will be entitled, without prior formalities and independently of any legal action, to demand from the Customer and at his expense, without the latter being able to oppose it under any reason whatsoever, the return of the equipment provided. In addition, EQUIMAF may also take unpaid goods back into the hands of sub-purchasers or demand direct payment from them. Until full payment of the price, the Customer may not pledge the products, exchange them, or transfer them as a guarantee. In addition, products delivered not yet fully paid for must remain individualized and not be mixed with other products.

 

Risk transfer

The retention of title clause does not preclude the transfer of risks to the Customer upon delivery of the goods: the transfer of risks of loss and deterioration of EQUIMAF products will be carried out upon delivery and receipt of the products by the Buyer or upon their abduction by the latter within EQUIMAF. Consequently, the Customer agrees to take all care in the custody and conservation of the goods and to take out any useful insurance. Regarding software, the Customer is reminded that no property rights are transferred to him. The only right it enjoys is a right of use in accordance with the conditions written on the licenses attached to the software.
